Chapter 4 - Legal Counterstrike

Penny was escorted off the military installation by base security, humiliated in front of dozens of onlookers. But instead of backing down, the incident pushed Martha and Penny over the edge.

Three days later, a process server arrived at my front door.

I opened the envelope to find a summons to civil court. Martha was suing me for "breach of verbal contract" and "filial support," claiming that I had promised to provide her with a monthly allowance for the rest of her life in exchange for her raising me and supporting my early military career. To make matters worse, she had requested an emergency court order for visitation rights to see Hazel.

I sat on my sofa, staring at the legal documents, feeling a cold rage settle into my bones. They weren't just asking for money anymore; they were trying to use the legal system to force their way into my daughter's life.

I immediately called Captain Vance, a senior legal assistance attorney on base who specialized in military family law. An hour later, I was sitting in his office, laying out the entire paper trail.

Captain Vance skimmed through the legal filing, shaking his head with a mixture of disbelief and quiet anger. "This lawsuit is completely frivolous, Mrs. Reed. 'Filial responsibility' laws rarely apply in this jurisdiction unless the parent is indigent and unable to care for themselves—and even then, it requires proof of severe neglect on your part. As for grand-parental visitation, courts almost never grant it against the wishes of a fit parent, especially when there's no pre-existing relationship with the child."

"What about the money she claims I promised her?" I asked.

"Do you have anything in writing?"

"No. Everything was done through emotional blackmail," I said. "She would text me saying she couldn't pay her rent, I would send money. Penny would claim her electricity was being shut off, I would send money. I kept every bank receipt, but there was never a contract."

Captain Vance smiled thinly. "Good. Because bank receipts without a loan agreement are legally considered gifts. They have no legal standing to demand repayment or ongoing support. But since they've taken this to court, we aren't just going to defend—we are going to counter-attack."

"What do you mean?"

"We are going to file a countersuit for financial harassment, illegal entry onto a military installation, and a formal restraining order against both your mother and sister," Captain Vance said, leaning forward. "And we are going to use every single piece of evidence you've gathered over the last ten years to ensure they never come within five hundred feet of you or Hazel again."
