Chapter 5 - The Collapse of the Consortium

The Multnomah County Courthouse was packed on Friday morning. Ashley’s father, Richard Vance (no relation to Marcus), sat at the petitioner’s table looking like a million dollars in a bespoke Italian suit, flanked by Ethan and Ashley. Ashley was wearing an oversized pair of designer sunglasses inside the courtroom, her expression smug as she whispered into her husband's ear. Ethan looked nervous, his eyes darting toward the door as Marcus and I entered the room.
Judge Sarah Henderson took the bench, her glasses resting on the tip of her nose as she reviewed the emergency petition for guardianship.
"We are here on a petition for temporary emergency guardianship and asset preservation filed by Ethan Mercer regarding his father, Thomas Mercer," Judge Henderson began, her voice echoing off the wood-paneled walls. "Mr. Richard Vance, you represent the petitioner. State your case."
Richard Vance stood up, smoothing his tie with an air of immense, unearned authority. "Your Honor, this is a tragic case of a proud, hardworking man whose cognitive faculties have unfortunately begun to fail him. Thomas Mercer has spent forty years building a reputable construction firm, but over the last month, his behavior has become increasingly erratic, vindictive, and dangerous to the economic viability of the company. He has unilaterally frozen corporate accounts, terminated core operational personnel without cause, and threatened his own son with criminal prosecution over routine accounting adjustments. We are asking for an immediate suspension of his voting shares to prevent the total liquidation of Mercer Holdings."
Judge Henderson nodded slowly, looking over at our table. "Mr. Marcus Vance, what is the respondent’s position?"
Marcus stood up, calmly adjusting his glasses. "Your Honor, we agree that a corporate officer’s faculties should be beyond reproach. That is why, on Wednesday afternoon, Thomas Mercer voluntarily underwent a six-hour comprehensive neurological and cognitive evaluation conducted by Dr. Charles Albright, the head of neurology at Oregon Health & Science University."
Marcus slid a thick, blue-bound medical report to the bailiff, who passed it up to the judge.
"As you can see from the findings, Your Honor," Marcus continued, "Thomas Mercer possesses the cognitive function, short-term memory, and spatial reasoning metrics of a man twenty years his junior. There is absolutely zero evidence of cognitive decline. What there is evidence of, however, is a massive, coordinated financial fraud designed to strip Mr. Mercer of his life’s work."
Richard Vance’s face stiffened. Ethan shifted uncomfortably in his seat.
"We have filed a cross-motion for immediate sanctions and a referral to the state police financial crimes unit," Marcus said, his voice rising in volume, filling the courtroom with an absolute authority. "We have subpoenaed the transaction records for EA Development LLC—the shell company Ethan Mercer created. The eighty-four thousand dollars diverted from active client deposits was wired directly into the operating account of Vance Real Estate Partners—the firm owned by the petitioner’s counsel, Richard Vance—to cover a defaulted commercial property tax lien on October 14th."
Ashley ripped her designer sunglasses off, her eyes wide with sudden, breathless terror. Richard Vance stumbled backward against his chair, his polished composure completely shattering as Judge Henderson looked up from the medical report, her face turning into a mask of pure stone.
"Mr. Richard Vance," Judge Henderson said, her voice dropping into a dangerous, icy register. "Are you telling me that you filed a mental incompetence petition against a client's father while actively receiving embezzled corporate funds into your own firm’s account?"
"Your Honor... I... I was under the impression it was a short-term business loan between family members!" Richard stammered, his face turning from pale to a deep, sickly gray.
"That is enough," Judge Henderson snapped, slamming her gavel down with a sharp, echoing crack. "The petition for guardianship is dismissed with prejudice. Furthermore, I am issuing an immediate bench warrant for the seizure of all electronic devices belonging to Ethan Mercer, Ashley Mercer, and Richard Vance. This courtroom is locked until county deputies arrive to take your statements for grand larceny and corporate conspiracy. Mr. Tom Mercer, you are fully restored to all executive functions. Court is adjourned."

Ethan buried his face in his hands, letting out a soft, pathetic sob as two uniform deputies stepped through the back door of the courtroom, their handcuffs gleaming under the fluorescent lights. Ashley turned on her father, screaming at him as the reality of their collapse finally hit them.
I stood up, fastened the button on my suit jacket, and walked out of the courtroom without looking back.
